1. Introduction
The following general conditions of contract apply to the lease agreement for temporary purposes stipulated by and between the Client and Rent Ok relating to the Property selected by the Client among those listed on the website www.rentok.it.
2. Booking policy and contract stipulation
2.1. Selecting a Property: The client may request information regarding the availability and price of the selected Property by sending the enquiry form available on the web site (hereinafter, the
‘Booking Request') to the Company.
2.2. Making a reservation: When the Client notifies the Company the intention of reserving the selected property, availability provided, the Company will promptly send the booking form to the Client (hereinafter, the
'Booking Confirmation'), specifying the full address of the Property, the period of stay, the full rental fee, additional costs (if any, see art. 3.1.), the amount of the Booking Fee and the Security Deposit as well as the number of persons who may occupy the Property.
For acceptance, the Client shall complete the form with the requested details, accept the general conditions of contract regulating the booking in subject and return the signed form to the Company
within 24 hours from receipt. The failure to follow the above-mentioned instructions shall make the Booking Confirmation null and void.
2.3. Contract stipulation: The Contract shall be deemed as made and
entered into upon receipt by the Company of the Booking Confirmation
undersigned in accordance with the provisions set forth in the
foregoing art. 2.2. as well as the payment of the Booking Fee (or
evidence of such payment).
3. Payment terms
3.1. The
Full Rental Fee (hearinafter,
Price OK) quoted in the Booking Confirmation refers to the entire period of stay or to the agreed monthly price (30 days). The
Booking Fee is a part of the Price OK and
must be paid in advance by wire transfer or credit card in order to complete the reservation. The
Balance is the remaining part of the Price OK, and it is due
7 days prior to arrival at the Property or at the check in day (if paid in cash). The
Additional Costs relate to the optional services (such as maid service or other services as provided for in art. 8.3. and art. 8.5) and internet access (if not already included in the Price OK). Such services will be invoiced with 21% VAT.
Unless otherwise provided for in the Booking Confirmation, the said price shall be intended as inclusive of initial and final cleaning (except as provided in subsequent art. 8.3 and art. 8.5), electricity and gas, heating and water consumption. In the case of
rentals equal to or longer than 30 days, the
costs of electricity and gas are included in the price up to a maximum defined by the type and size of the property and as further specified below:
- Studio (Loft / Mansarda included) => euro 50,00 / month (30 days)
- 1 bedroom (Loft / Mansarda included) => euro 75,00 / month (30 days)
- 2 bedrooms and bigger (Loft / Mansarda included) => euro 100,00 / month (30 days).
In the case of
rentals of less than 30 days, such charges are to be considered included in the price up to a maximum calculated
pro-rata on the above-mentioned monthly fees. Any exceptional fee applicable in singular cases will be duly communicated to the Client and highlighted in the booking form.
Meters reading will be performed upon check in and check out by an appointee of Rent Ok. At the end of the lease, should the bill exceed the limits, the extra costs will be retained from the Security Deposit (art. 4). The average cost per Kw of electricity is € 0.22 and the average cost per 1 m³ of gas is € 0.80, unless otherwise communicated to the Client in case of different method of calculation applicable to specific properties. If at check-out Rent Ok is not yet in possession of the report of consumption that is provided by the tenants’ committee at the end of every calendar month, the calculation will be made pro rata according to the number of days of occupation of the Property based on consumption played over the previous calendar month.
3.2. The Client will provide for the payment of the rental fee under the terms and conditions set forth in the Booking Confirmation.
For contracts with appointed period (fixed arrival and departure dates) the Client is required to pay the full rental fee prior to the start of the lease as envisaged in Article 3.1. For monthly contracts with silent renewal (every 30 days, the maximum period allowed is 12 months unless different agreement is previously made with the client), the monthly fee is due in advance,
at least 7 days before the beginning of every month of lease.
3.3. In case of delayed payments the Company may hand over the credit recovery practice to an external agency or a lawyer in order to obtain a payment injunction issued by a judge. Any procedural and legal costs in this regard will be charged to the Client.
4. Security Deposit
The Client shall be required to provide a Security Deposit upon arrival pursuant to the terms and conditions set forth in the Booking Confirmation. The amount of the Security Deposit depends on the duration of the stay and ranges from euro 300,00 to euro 1500,00. There may be exceptions for some luxury apartments and/or due to the presence of pets. The Security Deposit will be returned to the Client in full within 5 working days of the expiration of the contract, via bank transfer (even though previously paid in cash unless different agreement is previously made with the Client), once the bank details are notified to Rent Ok, or by crediting the Client the same amount originally charged through credit card (timing for the funds to actually reach the Client’s bank account will depend on the international banks- issuers of the credit cards), subject to any deductions provided in the foregoing art. 3.1. and the subsequent art. 8.3 and art. 8.5. as well as to any further charges which are owed to Rent Ok by the Client. Should the Property be found to have been damaged by the Client, the Company will be entitled to withhold part or all of the Security Deposit, without prejudice to the Company's right to claim compensation for any further damage caused. In which case, Rent Ok will refund the net amount of the deposit once received the exact economic assessment of damages by the Landlord.
5. Duration, withdrawal, renewal and cancellation of the Booking
5.1. The duration of the contract will be indicated in the Booking Confirmation.
For contracts with appointed period (fixed arrival and departure dates) the Client may ask an extension of the lease and Rent Ok reserves the right to grant it, subject to the availability of the property and the payment in advance for the entire period of extension. Any notice of withdrawal from the contract of lease shall be effected by written communication by fax or e-mail and will not lead to any refund of fees paid by the Client to Rent Ok, except where otherwise agreed between Parties.
5.2. For monthly contracts with silent renewal (every 30 days), the Client will be entitled to terminate the Agreement by sending written notice to the Company by fax, registered letter or e-mail
at least 21 days prior to the end of the monthly expiration, from which date it will take effect. In case of late cancellation, except where otherwise agreed between the Parties, it will still be required to pay 21 days of receipt of notice of leaving.
5.3. Should the Client
cancel the reservation prior to the check in date, the Company will be entitled to retain the entire amount paid upon confirmation of contract. In case of cancellation
less than 48 hours before the check in date, the Company will be entitled to retain the Price OK (the full rental fee) and to call the customer on payment of the balance if still unpaid upon late cancellation.
6. Replacement of the Property
The Company may replace the Property with another of identical or superior quality, should the Company be unable to guarantee the Client use of the Property due to events of force majeure or for any contingencies beyond the Company's control. If the Client has a reasonable and substantiated cause for refusing the Property offered by way of replacement, the Company will refund the Client the amounts paid. No further amounts shall be due by the Company to the Client.
7. Arrival and departure
7.1. The keys to the Property will be given on the spot to the Client by the Company's appointee, at such location and time as agreed by prior arrangement.
Check in and check out may take place between hrs 09.00 am and 7.00 pm from Monday to Friday.
Extra costs will apply for check in or check out during other hours or on weekends/holidays, and in the case of the Client's delayed arrival according to the criteria below specified:
- working days (Monday to Friday) before 9 am and between 7 pm and 10 pm: euro 20 + VAT
- working days (Monday to Friday) from 10 pm to midnight: euro 40 + VAT
- working days (Monday to Friday) past midnight: euro 80 + VAT
- weekends/holidays from 9 am to 7 pm: euro 20 + VAT
- weekends/holidays before 9 am and between 7 pm and 10 pm: euro 40 + VAT
- weekends/holidays after 10 pm: euro 80 + VAT.
In the case of such delays, check in will not be guaranteed after 10 pm.
In the event the Client is not able to occupy the Property from the day specified in the booking (delays, strikes, personal reasons, etc) the Client will not have the right to any reimbursement from Rent Ok. The provisions provided in this paragraph also apply to the departure from the Property.
7.2. Upon handing over the keys of the Property, the Rent Ok appointee will provide the Client with a short document containing information of the property and the list of the main behaving rules for the smooth conduct of the property accompanied by information about the average value / price for fixing/ mending interventions in case of basic damages caused to the property by the Client. The Client agrees to undersign the said form, without prejudice to his right to supply in writing any observation or comment.
8. Obligations of the Client
8.1. The customer agrees not to permit the stay in the property of a number of persons exceeding and / or different from what indicated in the Booking Confirmation. Failure to comply with such obligation shall entail payment to the Company of a penalty equivalent to 30% of the overall rental price for each person in excess and / or different from what stated upon reservation, provided that Rent Ok agrees to allow the exceeding persons to stay in the apartment. At check in the Client will need to show
a valid identification document (or copy of such), which may also be done in advance by fax or email.
8.2. The Client explicitly declares that each occupant of the Property complies with all legal requisites and regulations regarding residing in the territory of the Italian State, as specified by the law, either by being an Italian citizen or – in the case of foreign citizens – by having all the necessary visas and permits required for entering and residing in the country. The Client hereby assuming full responsibility for possessing and providing all required documents.
8.3. The Client undertakes to exercise due care and diligence in using the Property, and to keep it clean, refraining from any act which may damage the Property and/or cause damage to appurtenances thereof and/or annexed property and/or facilities contained therein. In the case of contracts equal or longer than 30 days the Client agrees to allow (as provided for in art. 9) a member of the Rent Ok staff to carry out periodic checks on the state of the property. Should any negligence be found in the use and maintenance of the property Rent Ok will carry out the actions necessary to restore the property to its original state informing the customer in advance and charging him for the involved costs.
The Client moreover undertakes to verify the state of any plants present inside or on balconies/terraces, and to keep clean and clear any gutters or drain pipes on the balconies/terraces in order to allow water to pass freely.
8.4. The Client agrees to use the property in full compliance of the tenants’ regulation and the basic rules of good neighborliness. The Client may not use the property for unlawful acts and prostitution.
8.5. The Client undertakes to return the Property in the same conditions as it was given upon check-in, and in details the following:
a) not to leave any washing-up;
b) to clear the refrigerator and freezer from any food or drink product;
c) to throw the rubbish bags in the proper bins according to the garbage collection in force in Italy (see relative document provided to the Client upon check-in).
Should one of the above mentioned points a) b) c) failed to be observed by the Client Rent Ok will have the right to withhold the
Extra Cost of Euro 40 + VAT from the security deposit (art. 4).
8.6. The Client undertakes to return the keys of the Property in such manner as will be agreed with Rent Ok.
8.7. The Client agrees not to reproduce and/or give to third parties the keys of the Property and/or reveal to third parties any access codes for the Property. The loss/damage of keys and/or locks will entail compensation of the cost of new locks and of 5 sets of keys.
8.8. The Client also agrees to take reasonable care and adopt the necessary safety measures to avoid unauthorized persons from accessing the Property for the entire duration of the lease as set forth in the Booking Confirmation. In the case of failure to comply with the said obligation, the Client shall be liable to the Company for any damage caused to the Property and/or items contained therein.
9. Right of access to the Property
The Company and/or any third parties appointed by the Company, identifiable upon request by the Client, shall have access to the Property to carry out any necessary repair and/or maintenance work. The Client will receive prior notice thereof, except in the case of an emergency. The Client undertakes to authorize visits to the Property for up to 4 hours a week if the Property has been put on the market for sale by the owner.
10. Pets
Unless expressly authorized in writing by the Company, the Client shall not be allowed to have pets of any kind in the Property. Rent Ok reserves the right to terminate the contract at any moment and request compensation of any damages if the Client, failing to comply with this provision, brings any species of animal to the Property disturbing neighbors and / or causing damages to the furniture of the Property. Furthermore Rent Ok reserves the right to withhold as a penalty the rental fees paid up to that moment and in any case the fee equivalent to at least 21 days as of the early termination of the lease contract.
11. Suspension of utilities
The Company will not be liable to the Client for any suspensions or interruptions of the electricity and/or gas and/or water supply and / or phone / internet line and / or Satellite TV for reasons beyond its control.
12. Express termination clause
12.1. The Company may cause this Contract to be terminated in accordance with Italian law by sending the Client written notice via email / fax, in any of the following events:
a) should the Client fail to pay the Booking Fee in accordance with the terms set forth in the Booking Confirmation or
b) should the Client fail to pay the Balance in accordance with the terms set forth in the Booking Confirmation or
c) should the Client fail to pay the Security Deposit set forth in the Booking Confirmation, pursuant to the terms and conditions set forth therein or
d) should the Client's conduct be contrary to taking due care of the property (see art. 8) or
e) should the Client fail to respect art. 10.
12.2. In the cases designated by letters b) and c), the Company will be entailed to retain, by way of penalty, the Booking Fee previously paid by the Client in accordance with the provisions set forth in the Booking Confirmation.
13. Liability
It is understood that, within the limits provided for by law, the amount of any compensable damage due to the Client will not exceed the amount actually paid by the Client to the Company under the contract.
14. Theft or damages
The Company will not be liable to the Client for any thefts perpetrated, with or without break-in or physical damages.
15. Governing Law and jurisdiction
These General terms and Conditions of Contract, as well as the Contract, shall be governed by Italian law. The exclusive jurisdiction for any dispute arising between the Client and Rent Ok in connection with the Contract shall be the Court of Milan.
